Starving Luxembourg? National Courts and the Preliminary Ruling Procedure

PhD project Isak is a PhD student focusing on EU procedural law, with a particular interest on the application of the preliminary ruling procedure at the national level.

The Preliminary ruling procedure (PRP) is often credited as one of the most important features in the EU legal order. Yet surprisingly little is known about the referral decision in the national courts, with a lack of comprehensive studies including the cases that do not find their way to the CJEU. By examining both referred and non-referred cases using Swedish court data, this study explores how the PRP operates at a national level. Swedish courts have previously been described as reluctant to refer, and this study reexamines this perception using a more complete dataset.
